T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 299\u2013356. maddeleri aras\u0131nda d\u00fczenlenmi\u015ftir. \u0130\u015fte kapsaml\u0131 bir kira s\u00f6zle\u015fmesinin i\u00e7ermesi gereken temel unsurlar:<\/p>\n<ul>\n<li><strong>Taraf Bilgileri<\/strong>\n<ul>\n<li>Kiraya verenin ve kirac\u0131n\u0131n ad\u0131, soyad\u0131, T.C. kimlik numaras\u0131, adresi ve ileti\u015fim bilgileri<\/li>\n<\/ul>\n<\/li>\n<li><strong>Ta\u015f\u0131nmaz\u0131n Tan\u0131m\u0131<\/strong>\n<ul>\n<li>Kiralanan yerin a\u00e7\u0131k adresi, tapu bilgileri, ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm numaras\u0131, kullan\u0131m amac\u0131 (konut, i\u015fyeri vb.)<\/li>\n<\/ul>\n<\/li>\n<li><strong>Kira Bedeli ve \u00d6deme \u015eartlar\u0131<\/strong>\n<ul>\n<li>Ayl\u0131k kira tutar\u0131<\/li>\n<li>\u00d6deme \u015fekli (nakit, banka havalesi vb.)<\/li>\n<li>\u00d6deme g\u00fcn\u00fc ve gecikme halinde uygulanacak yapt\u0131r\u0131mlar<\/li>\n<\/ul>\n<\/li>\n<li><strong>Kira S\u00fcresi<\/strong>\n<ul>\n<li>Ba\u015flang\u0131\u00e7 ve biti\u015f tarihleri<\/li>\n<li>S\u00fcre sonunda uzama ko\u015fullar\u0131<\/li>\n<\/ul>\n<\/li>\n<li><strong>Depozito Bilgisi<\/strong>\n<ul>\n<li>Al\u0131nan depozito miktar\u0131<\/li>\n<li>\u0130ade \u015fartlar\u0131<\/li>\n<\/ul>\n<\/li>\n<li><strong>Demirba\u015flar ve Durum Tespiti<\/strong>\n<ul>\n<li>Ta\u015f\u0131nmazda bulunan e\u015fyalar\u0131n listesi<\/li>\n<li>Teslimdeki fiziksel durumun belirtilmesi<\/li>\n<\/ul>\n<\/li>\n<li><strong>Bak\u0131m, Onar\u0131m ve Masraflar<\/strong>\n<ul>\n<li>Hangi masraflar\u0131n kirac\u0131ya, hangilerinin kiraya verene ait oldu\u011fu<\/li>\n<\/ul>\n<\/li>\n<li><strong>Tahliye \u015eartlar\u0131 ve Fesih H\u00fck\u00fcmleri<\/strong>\n<ul>\n<li>Erken fesih durumunda uygulanacak prosed\u00fcr<\/li>\n<li>Tahliye i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcre ve bildirim \u015fekli<\/li>\n<\/ul>\n<\/li>\n<li><strong>\u00d6zel \u015eartlar<\/strong><\/li>\n<\/ul>\n<ul>\n<li>Evcil hayvan izni, alt kiralama yasa\u011f\u0131, tadilat izni gibi taraflarca belirlenen \u00f6zel h\u00fck\u00fcmler<\/li>\n<\/ul>\n<ul>\n<li>Kira kontrat\u0131n\u0131n <strong>noter onayl\u0131 olmas\u0131 zorunlu de\u011fildir<\/strong>. T\u00fcrk Bor\u00e7lar Kanunu\u2019na g\u00f6re kira s\u00f6zle\u015fmeleri, yaz\u0131l\u0131 veya s\u00f6zl\u00fc \u015fekilde yap\u0131labilir ve noter onay\u0131 olmaks\u0131z\u0131n da ge\u00e7erlidir. Ancak noter onay\u0131, s\u00f6zle\u015fmeye <strong>resm\u00ee belge niteli\u011fi<\/strong> kazand\u0131rarak baz\u0131 \u00f6nemli avantajlar sa\u011flar:<\/li>\n<li><strong>Hukuki G\u00fcvence<\/strong><\/li>\n<\/ul>\n<p>Noter onayl\u0131 s\u00f6zle\u015fmeler, mahkemelerde g\u00fc\u00e7l\u00fc bir delil olarak kabul edilir. Taraflar\u0131n iradesi noter taraf\u0131ndan do\u011fruland\u0131\u011f\u0131 i\u00e7in ge\u00e7erlili\u011fi daha sa\u011flamd\u0131r.<\/p>\n<ul>\n<li><strong>Resmi Kay\u0131t Alt\u0131na Al\u0131nma<\/strong><br \/>\nS\u00f6zle\u015fme noter taraf\u0131ndan ar\u015fivlenir. Bu, ileride do\u011fabilecek uyu\u015fmazl\u0131klarda s\u00f6zle\u015fmenin i\u00e7eri\u011fini ve tarihini kan\u0131tlamay\u0131 kolayla\u015ft\u0131r\u0131r.<\/li>\n<li><strong>\u0130spat Kolayl\u0131\u011f\u0131<\/strong><br \/>\n\u00d6zellikle kira bedeli, depozito, tahliye \u015fartlar\u0131 gibi konularda anla\u015fmazl\u0131k \u00e7\u0131karsa, noter onayl\u0131 s\u00f6zle\u015fme do\u011frudan delil olarak sunulabilir.<\/li>\n<li><strong>Taraflar Aras\u0131nda G\u00fcven<\/strong><br \/>\nNoter i\u015flemi hem kirac\u0131 hem de kiraya veren a\u00e7\u0131s\u0131ndan g\u00fcven ortam\u0131 yarat\u0131r. \u00d6zellikle y\u00fcksek bedelli veya ticari kiralamalarda tercih edilir.<\/li>\n<\/ul>\n<p><strong><u>DEPOZ\u0130TO MESELES\u0130<\/u><\/strong><\/p>\n<p><strong>Depozito (g\u00fcvence bedeli)<\/strong>, kira s\u00f6zle\u015fmesinde kiraya verenin olas\u0131 zararlar\u0131n\u0131 veya kirac\u0131n\u0131n s\u00f6zle\u015fmeden do\u011fan bor\u00e7lar\u0131n\u0131 teminat alt\u0131na almak amac\u0131yla kirac\u0131dan al\u0131nan bir miktar parad\u0131r. T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 342. maddesi bu konuda temel d\u00fczenlemeyi getirir.<\/p>\n<p><strong><em>Depozito Nedir ve Ne Kadar Al\u0131nabilir?<\/em><\/strong><\/p>\n<ul>\n<li><strong>Tan\u0131m\u0131:<\/strong> Kiralanan ta\u015f\u0131nmaz\u0131n zarar g\u00f6rmesi, kira borcunun \u00f6denmemesi gibi risklere kar\u015f\u0131 al\u0131nan teminatt\u0131r.<\/li>\n<li><strong>Yasal S\u0131n\u0131r:<\/strong>\n<ul>\n<li>TBK m.342\u2019ye g\u00f6re <strong>konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda depozito en fazla \u00fc\u00e7 ayl\u0131k kira bedeli<\/strong> kadar olabilir.<\/li>\n<li>Bu s\u0131n\u0131r\u0131 a\u015fan miktar ge\u00e7ersiz say\u0131l\u0131r ve kirac\u0131 fazla k\u0131sm\u0131n iadesini talep edebilir.<\/li>\n<\/ul>\n<\/li>\n<li><strong>\u015eekli:<\/strong><\/li>\n<\/ul>\n<ul>\n<li>Para veya k\u0131ymetli evrak olarak verilebilir.<\/li>\n<li>Para olarak verilecekse, kiraya verenin onay\u0131 olmadan \u00e7ekilemeyecek \u015fekilde <strong>vadeli bir banka hesab\u0131na<\/strong> yat\u0131r\u0131lmal\u0131d\u0131r.<\/li>\n<\/ul>\n<p><strong><em>Depozito Hangi Durumlarda Kirac\u0131ya \u0130ade Edilmez?<\/em><\/strong><\/p>\n<p>Depozito, kira s\u00f6zle\u015fmesi sona erdi\u011finde kirac\u0131ya iade edilmelidir. Ancak baz\u0131 durumlarda iade edilmez veya kesinti yap\u0131labilir:<\/p>\n<ul>\n<li><strong>Kiralananda ola\u011fan d\u0131\u015f\u0131 zarar varsa:<\/strong>\n<ul>\n<li>Kirac\u0131n\u0131n kullan\u0131m\u0131ndan kaynakl\u0131 <strong>hasar, k\u0131r\u0131k, boya bozulmas\u0131, tesisat ar\u0131zas\u0131<\/strong> gibi durumlar varsa, kiraya veren bu zararlar\u0131 depozitodan kar\u015f\u0131layabilir.<\/li>\n<\/ul>\n<\/li>\n<li><strong>\u00d6denmemi\u015f bor\u00e7lar varsa:<\/strong>\n<ul>\n<li>Aidat, elektrik, su, do\u011falgaz gibi <strong>abonelik bor\u00e7lar\u0131<\/strong> veya <strong>\u00f6denmemi\u015f kira bedelleri<\/strong> varsa kesinti yap\u0131labilir.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Teslim tutana\u011f\u0131 yoksa veya eksik teslim varsa:<\/strong>\n<ul>\n<li>Kirac\u0131 ta\u015f\u0131nmaz\u0131 teslim etti\u011fine dair belge sunmazsa, depozito iadesi gecikebilir veya reddedilebilir.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Mahkeme karar\u0131 veya icra takibi varsa:<\/strong><\/li>\n<\/ul>\n<ul>\n<li>Kiraya veren, s\u00f6zle\u015fme sona erdikten sonra <strong>3 ay i\u00e7inde dava a\u00e7t\u0131\u011f\u0131n\u0131 veya icra takibi ba\u015flatt\u0131\u011f\u0131n\u0131 bankaya bildirirse<\/strong>, depozito iadesi durdurulabilir.<\/li>\n<\/ul>\n<ul>\n<li>Hem ticari hem de konut kiralamalar\u0131nda <strong>depozito (g\u00fcvence bedeli)<\/strong> d\u00fczenlemesi ve banka hesab\u0131 a\u00e7ma prosed\u00fcr\u00fc, T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 342. maddesi \u00e7er\u00e7evesinde \u015fekillenir.<\/li>\n<\/ul>\n<p><strong><em>Depozito S\u00f6zle\u015fme D\u00fczenlemesi<\/em><\/strong><\/p>\n<p>Ticari Kiralamalarda<\/p>\n<ul>\n<li><strong>Depozito zorunlu de\u011fildir<\/strong>, ancak s\u00f6zle\u015fmede a\u00e7\u0131k\u00e7a belirtilmelidir.<\/li>\n<li><strong>\u00dcst s\u0131n\u0131r:<\/strong> E\u011fer kiralanan yer \u00e7at\u0131l\u0131 i\u015fyeri ise, <strong>en fazla 3 ayl\u0131k kira bedeli<\/strong> kadar depozito al\u0131nabilir (TBK m.342).<\/li>\n<li><strong>S\u00f6zle\u015fme metninde yer almas\u0131 gerekenler:<\/strong><\/li>\n<\/ul>\n<ul>\n<li>Depozito miktar\u0131 ve \u00f6deme tarihi<\/li>\n<li>Depozitonun hangi bor\u00e7lara kar\u015f\u0131 teminat oldu\u011fu (kira, aidat, hasar vb.)<\/li>\n<li>\u0130ade ko\u015fullar\u0131 ve s\u00fcresi<\/li>\n<li>Bankaya yat\u0131r\u0131lacaksa hesap bilgileri ve taraflar\u0131n onay\u0131<\/li>\n<\/ul>\n<p>Konut Kiralamalar\u0131nda<\/p>\n<ul>\n<li><strong>Depozito yine zorunlu de\u011fil<\/strong>, ancak s\u00f6zle\u015fmede yer almas\u0131 gerekir.<\/li>\n<li><strong>\u00dcst s\u0131n\u0131r:<\/strong> En fazla 3 ayl\u0131k kira bedeli (TBK m.342).<\/li>\n<li><strong>S\u00f6zle\u015fme metninde yer almas\u0131 gerekenler:<\/strong><\/li>\n<\/ul>\n<ul>\n<li>Depozito miktar\u0131 (\u00f6rne\u011fin: \u201cKirac\u0131, 2 ayl\u0131k kira bedeli tutar\u0131nda 40.000 TL depozito \u00f6demeyi kabul eder.\u201d)<\/li>\n<li>Depozitonun vadeli banka hesab\u0131na yat\u0131r\u0131laca\u011f\u0131na dair h\u00fck\u00fcm<\/li>\n<li>\u0130ade s\u00fcreci: \u201cKiralanan ta\u015f\u0131nmaz\u0131n hasars\u0131z teslimi ve bor\u00e7suzluk halinde depozito iade edilir.\u201d<\/li>\n<li>\u0130ade \u015fekli: banka hesab\u0131na, nakit, k\u0131ymetli evrak vb.<\/li>\n<\/ul>\n<p><strong>Not:<\/strong> Depozito, s\u00f6zle\u015fmede hangi bor\u00e7lara kar\u015f\u0131l\u0131k teminat oldu\u011fu belirtilmezse, Yarg\u0131tay i\u00e7tihatlar\u0131na g\u00f6re <strong>kirac\u0131n\u0131n t\u00fcm bor\u00e7lar\u0131na kar\u015f\u0131 teminat<\/strong> olarak kabul edilir.<\/p>\n<p><strong><em>Banka Hesab\u0131 A\u00e7ma Prosed\u00fcr\u00fc (Depozito \u0130\u00e7in)<\/em><\/strong><\/p>\n<p><em><u>Yasal D\u00fczenleme<\/u><\/em><\/p>\n<ul>\n<li>TBK m.342\/2: \u201cG\u00fcvence olarak para verilmesi kararla\u015ft\u0131r\u0131lm\u0131\u015fsa, kirac\u0131 bu paray\u0131 <strong>kiraya verenin onay\u0131 olmaks\u0131z\u0131n \u00e7ekilemeyecek \u015fekilde vadeli bir tasarruf hesab\u0131na yat\u0131r\u0131r<\/strong>.\u201d<\/li>\n<\/ul>\n<p><em><u>!!! Uygulamada \u00e7o\u011fu zaman depozito do\u011frudan kiraya verene nakit olarak verilir. Ancak bu, TBK\u2019ya ayk\u0131r\u0131d\u0131r ve ileride iade konusunda sorun yaratabilir.<\/u><\/em><\/p>\n<p><strong>\u00d6rnek S\u00f6zle\u015fme H\u00fckm\u00fc: <\/strong>Kirac\u0131, bu s\u00f6zle\u015fme kapsam\u0131nda 2 ayl\u0131k kira bedeli tutar\u0131nda 40.000 TL g\u00fcvence bedelini, kiraya verenin onay\u0131 olmaks\u0131z\u0131n \u00e7ekilemeyecek \u015fekilde vadeli bir tasarruf hesab\u0131na yat\u0131racakt\u0131r. Kira s\u00f6zle\u015fmesinin sona ermesiyle birlikte, kiralanan\u0131n hasars\u0131z teslimi ve kirac\u0131n\u0131n bor\u00e7suzlu\u011fu halinde, g\u00fcvence bedeli banka taraf\u0131ndan kirac\u0131ya iade edilir.<\/p>\n<p><strong><u>KEF\u0130LL\u0130K HAKKINDA<\/u><\/strong><\/p>\n<p><strong>Ev sahibi kirac\u0131dan kefil istemekte serbesttir<\/strong>. Bu, \u00f6zellikle kira bedelinin y\u00fcksek oldu\u011fu veya kirac\u0131n\u0131n \u00f6deme g\u00fcc\u00fcne dair teredd\u00fctlerin bulundu\u011fu durumlarda s\u0131k\u00e7a ba\u015fvurulan bir g\u00fcvence y\u00f6ntemidir. Ancak kefillik, basit bir imzadan \u00e7ok daha fazlas\u0131n\u0131 ifade eder\u2014<strong>ciddi hukuki ve mali sorumluluklar<\/strong> do\u011furur.<\/p>\n<p><strong><em>Kefillik Hukuki Dayanaklar\u0131<\/em><\/strong><\/p>\n<ul>\n<li><strong>T\u00fcrk Bor\u00e7lar Kanunu (TBK) m.581\u2013603<\/strong> aras\u0131nda kefalet h\u00fck\u00fcmleri d\u00fczenlenmi\u015ftir.<\/li>\n<li><strong>TBK m.584:<\/strong> Evli bir ki\u015finin kefil olabilmesi i\u00e7in e\u015finin yaz\u0131l\u0131 r\u0131zas\u0131 gerekir.<\/li>\n<li><strong>TBK m.598:<\/strong> Ger\u00e7ek ki\u015fi kefilin sorumlulu\u011fu, en fazla 10 y\u0131l ile s\u0131n\u0131rl\u0131d\u0131r.<\/li>\n<li><strong>TBK m.583:<\/strong> Kefil, kira s\u00f6zle\u015fmesinin uzayan d\u00f6nemlerinden ancak a\u00e7\u0131k\u00e7a belirtilmi\u015fse sorumlu olur.<\/li>\n<\/ul>\n<p><strong><em>Kefilin Sorumluluklar\u0131 Nelerdir?<\/em><\/strong><\/p>\n<ol>\n<li><strong>Bor\u00e7tan Sorumluluk T\u00fcr\u00fc<\/strong><\/li>\n<\/ol>\n<ul>\n<li><strong>Adi Kefil:<\/strong> Ev sahibi \u00f6nce kirac\u0131ya ba\u015fvurmak zorundad\u0131r. Kirac\u0131dan tahsil edilemezse kefile y\u00f6nelir.<\/li>\n<li><strong>M\u00fcteselsil Kefil:<\/strong> Ev sahibi do\u011frudan kefile ba\u015fvurabilir. \u201c\u00d6nce kirac\u0131dan al\u201d deme hakk\u0131 yoktur.<\/li>\n<\/ul>\n<ol start=\"2\">\n<li><strong>Sorumluluk Kapsam\u0131<\/strong><\/li>\n<\/ol>\n<ul>\n<li>Ayl\u0131k kira bedelleri<\/li>\n<li>Gecikme faizleri<\/li>\n<li>Aidat bor\u00e7lar\u0131 (s\u00f6zle\u015fmede belirtilmi\u015fse)<\/li>\n<li>Dava ve icra masraflar\u0131<\/li>\n<li>Ancak: <strong>Depozito, cezai \u015fartlar, tahliye masraflar\u0131 gibi kalemler i\u00e7in kefilin ayr\u0131ca a\u00e7\u0131k\u00e7a sorumlu oldu\u011fu belirtilmelidir<\/strong>.<\/li>\n<\/ul>\n<ol start=\"3\">\n<li><strong>S\u00fcre ve Limit<\/strong><\/li>\n<\/ol>\n<ul>\n<li>Kefalet s\u00fcresi genellikle <strong>ilk kira y\u0131l\u0131yla s\u0131n\u0131rl\u0131d\u0131r<\/strong>, uzayan d\u00f6nemler i\u00e7in a\u00e7\u0131k h\u00fck\u00fcm gerekir.<\/li>\n<li>S\u00f6zle\u015fmede <strong>azami tutar<\/strong> belirtilmelidir. Aksi takdirde kefil s\u0131n\u0131rs\u0131z sorumluluk \u00fcstlenmi\u015f say\u0131labilir.<\/li>\n<\/ul>\n<ol start=\"4\">\n<li><strong>R\u00fccu Hakk\u0131<\/strong><\/li>\n<\/ol>\n<ul>\n<li>Kefil, kirac\u0131n\u0131n borcunu \u00f6derse, <strong>r\u00fccu hakk\u0131<\/strong> do\u011far.
