Bu y\u00fck\u00fcml\u00fcl\u00fcklerin ba\u015f\u0131nda ise kira bedelinin zaman\u0131nda ve uygun \u015fekilde \u00f6denmesi gelir. Peki kira ne zaman ve nas\u0131l \u00f6denmelidir?<\/p>\n<p><strong><u>S\u00f6zle\u015fmede Belirtilmi\u015fse<\/u><\/strong><\/p>\n<p>Kira s\u00f6zle\u015fmesinde \u00f6deme tarihi a\u00e7\u0131k\u00e7a belirtilmi\u015fse, kirac\u0131 bu tarihte \u00f6deme yapmakla y\u00fck\u00fcml\u00fcd\u00fcr. \u00d6rne\u011fin:<\/p>\n<p>&#8220;Kira bedeli her ay\u0131n en ge\u00e7 5\u2019ine kadar \u00f6denecektir.&#8221;<\/p>\n<p>Bu gibi h\u00fck\u00fcmler, ba\u011flay\u0131c\u0131l\u0131\u011f\u0131 olan birer y\u00fck\u00fcml\u00fcl\u00fck haline gelir.<\/p>\n<p><strong><u>S\u00f6zle\u015fmede Belirtilmemi\u015fse<\/u><\/strong><\/p>\n<p>S\u00f6zle\u015fmede herhangi bir tarih yoksa, <strong>T\u00fcrk Bor\u00e7lar Kanunu m.314<\/strong> uyar\u0131nca kira bedeli her ay\u0131n sonunda \u00f6denmelidir. Ancak uygulamada &#8220;pe\u015fin&#8221; ibaresi varsa bu, ay\u0131n ba\u015f\u0131nda \u00f6deme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc do\u011furabilir.<\/p>\n<p><strong><u>Tatil G\u00fcnlerine Denk Gelirse<\/u><\/strong><\/p>\n<p>\u00d6deme g\u00fcn\u00fc resm\u00ee tatil veya hafta sonuna denk gelirse, \u00f6deme s\u00fcresi <strong>takip eden ilk i\u015f g\u00fcn\u00fc<\/strong>ne uzar.<\/p>\n<p><em><u>Kira \u00d6demesinin Y\u00f6ntemi<\/u><\/em><\/p>\n<p>Kiran\u0131n nas\u0131l \u00f6denece\u011fi de en az zaman\u0131 kadar \u00f6nemlidir. \u0130\u015fte en yayg\u0131n ve g\u00fcvenli \u00f6deme y\u00f6ntemleri:<\/p>\n<ul>\n<li><strong>Banka Havalesi \/ EFT \/ FAST<\/strong>: En s\u0131k tercih edilen y\u00f6ntem. Dekont, hukuki anlamda ispat arac\u0131 olarak kullan\u0131l\u0131r.<\/li>\n<li><strong>Otomatik \u00d6deme Talimat\u0131<\/strong>: Banka \u00fczerinden verilen talimatlarla her ay d\u00fczenli \u00f6deme yap\u0131labilir.<\/li>\n<li><strong>Elden (Nakit) \u00d6deme<\/strong>: Ancak mutlaka <strong>makbuz al\u0131nmal\u0131<\/strong>; aksi halde \u00f6deme yap\u0131ld\u0131\u011f\u0131 ispatlanamayabilir.<\/li>\n<li><strong>Dijital C\u00fczdanlar \/ Online Platformlar<\/strong>: \u00d6zellikle dijital kira takibi sa\u011flayan platformlar aras\u0131nda yer al\u0131r.<\/li>\n<\/ul>\n<p><strong>Not:<\/strong> Hangi y\u00f6ntem se\u00e7ilirse se\u00e7ilsin, \u00f6deme belgesi saklanmal\u0131d\u0131r. Bu belge, olas\u0131 bir hukuki uyu\u015fmazl\u0131kta kirac\u0131n\u0131n en g\u00fc\u00e7l\u00fc kan\u0131t\u0131d\u0131r.<\/p>\n<p><em><u>Gecikme Durumunda Ne Olur?<\/u><\/em><\/p>\n<p>Kira zaman\u0131nda \u00f6denmezse, kiraya veren <strong>noter veya yaz\u0131l\u0131 ihtar yoluyla<\/strong> kirac\u0131ya \u00f6deme yapmas\u0131 i\u00e7in s\u00fcre tan\u0131r. \u00d6zellikle konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda:<\/p>\n<ul>\n<li>Kirac\u0131ya <strong>30 g\u00fcnl\u00fck s\u00fcre<\/strong> verilir.<\/li>\n<li>Bu s\u00fcre sonunda \u00f6deme yap\u0131lmazsa, <strong>tahliye davas\u0131 a\u00e7\u0131labilir<\/strong> (<strong>TBK m.352<\/strong>)<\/li>\n<\/ul>\n<p><strong><u>K\u0130RA ARTI\u015eI MESELES\u0130<\/u><\/strong><\/p>\n<p><em><u>Kira Art\u0131\u015f Oran\u0131n\u0131n Belirlenmesi<\/u><\/em><\/p>\n<p>S\u00f6zle\u015fmede Art\u0131\u015f Oran\u0131 Belirtilmi\u015fse<\/p>\n<ul>\n<li>Taraflar kira s\u00f6zle\u015fmesinde <strong>y\u0131ll\u0131k art\u0131\u015f oran\u0131<\/strong> belirleyebilir.<\/li>\n<li>Ancak bu oran, <strong>T\u00dcFE 12 ayl\u0131k ortalamas\u0131n\u0131 ge\u00e7emez<\/strong> (TBK m.344).<\/li>\n<li>\u00d6rne\u011fin s\u00f6zle\u015fmede %50 art\u0131\u015f \u00f6ng\u00f6r\u00fclm\u00fc\u015fse, T\u00dcFE ortalamas\u0131 %40 ise, ge\u00e7erli oran %40 olacakt\u0131r.<\/li>\n<\/ul>\n<p>S\u00f6zle\u015fmede Art\u0131\u015f Oran\u0131 Yoksa<\/p>\n<ul>\n<li>TBK m.344\u2019e g\u00f6re, kira bedeli <strong>bir \u00f6nceki y\u0131l\u0131n T\u00dcFE 12 ayl\u0131k ortalamas\u0131na g\u00f6re<\/strong> art\u0131r\u0131l\u0131r.<\/li>\n<li>Hakim, kiralanan\u0131n durumu ve emsal kira bedellerini dikkate alarak <strong>hakkaniyete uygun bir art\u0131\u015f<\/strong> belirleyebilir.<\/li>\n<\/ul>\n<p><em><u>Yasal \u00dcst S\u0131n\u0131r Var m\u0131?<\/u><\/em><\/p>\n<p>Ge\u00e7mi\u015fteki %25 S\u0131n\u0131r\u0131<\/p>\n<ul>\n<li>11 Haziran 2022 \u2013 1 Temmuz 2024 aras\u0131nda konut kiralar\u0131nda <strong>%25 art\u0131\u015f s\u0131n\u0131r\u0131<\/strong> uygulan\u0131yordu.<\/li>\n<li>Bu s\u0131n\u0131rlama <strong>1 Temmuz 2024 itibariyle kald\u0131r\u0131ld\u0131<\/strong>.<\/li>\n<\/ul>\n<p>G\u00fcncel Durum (2025 itibariyle)<\/p>\n<ul>\n<li>Art\u0131k hem konut hem de i\u015fyeri kiralar\u0131nda <strong>T\u00dcFE 12 ayl\u0131k ortalamas\u0131<\/strong> \u00fcst s\u0131n\u0131r olarak ge\u00e7erlidir.<\/li>\n<li>Taraflar bu oran\u0131n alt\u0131nda bir art\u0131\u015fta anla\u015fabilir, ancak \u00fcst\u00fcne \u00e7\u0131kamazlar.<\/li>\n<\/ul>\n<p>\u00d6rnek Hesaplama<\/p>\n<p>Mevcut kira bedeli: 10.000 TL Son 12 ayl\u0131k T\u00dcFE ortalamas\u0131: %65 Art\u0131\u015f miktar\u0131: 10.000 TL \u00d7 0.65 = 6.500 TL Yeni kira bedeli: 10.000 TL + 6.500 TL = 16.500 TL<\/p>\n<p>Not: T\u00dcFE oranlar\u0131 her ay T\u00dc\u0130K taraf\u0131ndan a\u00e7\u0131klan\u0131r. G\u00fcncel oranlara g\u00f6re hesaplama yap\u0131lmal\u0131d\u0131r.<\/p>\n<p><em><u>5 Y\u0131l ve \u00dczeri S\u00f6zle\u015fmelerde Durum<\/u><\/em><\/p>\n<ul>\n<li>Kira s\u00f6zle\u015fmesi <strong>5 y\u0131l\u0131 a\u015fm\u0131\u015fsa<\/strong>, TBK m.344\/3 uyar\u0131nca:<\/li>\n<\/ul>\n<ul>\n<li>H\u00e2kim, T\u00dcFE oran\u0131 yan\u0131nda <strong>kiralanan\u0131n durumu ve emsal bedelleri<\/strong> de dikkate alarak yeni kira bedelini belirler.<\/li>\n<li>Bu d\u00fczenleme, kiraya verenin kira tespit davas\u0131 a\u00e7mas\u0131na olanak tan\u0131r.<\/li>\n<\/ul>\n<p>T\u00dcFE (T\u00fcketici Fiyat Endeksi), kira art\u0131\u015f oranlar\u0131n\u0131n belirlenmesinde <strong>temel ekonomik g\u00f6sterge<\/strong> olarak kullan\u0131l\u0131r. T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 344. maddesi uyar\u0131nca, kira s\u00f6zle\u015fmesinde aksi belirtilmedik\u00e7e, kira bedeli art\u0131\u015flar\u0131 <strong>T\u00dcFE\u2019nin 12 ayl\u0131k ortalamas\u0131na g\u00f6re<\/strong> yap\u0131l\u0131r.<\/p>\n<p><em><u>T\u00dcFE ve Kira Art\u0131\u015f\u0131 Aras\u0131ndaki Hukuki \u0130li\u015fki<\/u><\/em><\/p>\n<p>Mevzuat Dayana\u011f\u0131<\/p>\n<ul>\n<li><strong>TBK m.344:<\/strong><\/li>\n<\/ul>\n<ul>\n<li>Taraflar kira s\u00f6zle\u015fmesinde art\u0131\u015f oran\u0131 belirlemi\u015f olsa bile, bu oran <strong>T\u00dcFE 12 ayl\u0131k ortalamas\u0131n\u0131 ge\u00e7emez<\/strong>.<\/li>\n<li>Belirtilmemi\u015fse, kira art\u0131\u015f\u0131 do\u011frudan T\u00dcFE ortalamas\u0131na g\u00f6re yap\u0131l\u0131r.<\/li>\n<li>5 y\u0131l\u0131 a\u015fan s\u00f6zle\u015fmelerde, hakim emsal kira bedelleri ve ta\u015f\u0131nmaz\u0131n durumu gibi unsurlar\u0131 da dikkate alarak art\u0131\u015f oran\u0131n\u0131 belirleyebilir.<\/li>\n<\/ul>\n<p>G\u00fcncel Uygulama (A\u011fustos 2025)<\/p>\n<ul>\n<li><strong>T\u00dc\u0130K verilerine g\u00f6re<\/strong>, Temmuz 2025 itibar\u0131yla <strong>T\u00dcFE\u2019nin 12 ayl\u0131k ortalamas\u0131 %41,13<\/strong> olarak a\u00e7\u0131kland\u0131.<\/li>\n<li>Bu oran, <strong>i\u015fyeri kiralar\u0131<\/strong> i\u00e7in do\u011frudan uygulanabilir.<\/li>\n<li><strong>Konut kiralar\u0131<\/strong> i\u00e7in ise 1 Temmuz 2024\u2019te sona eren %25\u2019lik yasal tavan\u0131n ard\u0131ndan art\u0131k <strong>T\u00dcFE oran\u0131 esas al\u0131nmaktad\u0131r<\/strong>.<\/li>\n<\/ul>\n<p>\u00d6rnek Hesaplama<\/p>\n<p>Mevcut kira: 20.000 TL T\u00dcFE 12 ayl\u0131k ortalama: %41,13 Art\u0131\u015f tutar\u0131: 20.000 \u00d7 0,4113 = 8.226 TL Yeni kira: 28.226 TL<\/p>\n<p>Neden T\u00dcFE Kullan\u0131l\u0131r?<\/p>\n<ul>\n<li>T\u00dcFE, t\u00fcketici fiyatlar\u0131ndaki genel de\u011fi\u015fimi g\u00f6sterdi\u011fi i\u00e7in <strong>enflasyonla uyumlu kira art\u0131\u015f\u0131 sa\u011flar<\/strong>.<\/li>\n<li>Hem kirac\u0131 hem de kiraya veren a\u00e7\u0131s\u0131ndan <strong>adil ve \u00f6ng\u00f6r\u00fclebilir bir art\u0131\u015f mekanizmas\u0131<\/strong> sunar.<\/li>\n<li>Yarg\u0131tay kararlar\u0131nda da T\u00dcFE oran\u0131n\u0131n <strong>emredici s\u0131n\u0131r<\/strong> oldu\u011fu vurgulanm\u0131\u015ft\u0131r.<\/li>\n<\/ul>\n<p>Kira art\u0131\u015f\u0131nda ev sahibi ve kirac\u0131 uzla\u015famazsa, s\u00fcre\u00e7 <strong>dava ve arabuluculuk yollar\u0131yla<\/strong> ilerler. Bu durum hem kirac\u0131n\u0131n hem de ev sahibinin haklar\u0131n\u0131 do\u011frudan etkileyen bir uyu\u015fmazl\u0131k t\u00fcr\u00fcd\u00fcr.<\/p>\n<p><em><u>Anla\u015fmazl\u0131k Durumunda \u0130zlenecek Yollar<\/u><\/em><\/p>\n<ol>\n<li>Yaz\u0131l\u0131 Bildirim ve M\u00fczakere<\/li>\n<\/ol>\n<ul>\n<li>Ev sahibi, kira art\u0131\u015f\u0131n\u0131 <strong>yaz\u0131l\u0131 olarak<\/strong> bildirmelidir (genellikle en az 30 g\u00fcn \u00f6nceden).<\/li>\n<li>Kirac\u0131 bu art\u0131\u015f\u0131 <strong>kabul etmeyebilir<\/strong> ve m\u00fczakere s\u00fcreci ba\u015flar.<\/li>\n<li>Taraflar aras\u0131nda uzla\u015fma sa\u011flanamazsa, hukuki yollar devreye girer.<\/li>\n<\/ul>\n<ol start=\"2\">\n<li>Arabuluculuk S\u00fcreci<\/li>\n<\/ol>\n<ul>\n<li>1 Eyl\u00fcl 2023 itibar\u0131yla, <strong>kira uyu\u015fmazl\u0131klar\u0131nda arabuluculuk zorunlu hale gelmi\u015ftir<\/strong>.<\/li>\n<li>Taraflar \u00f6nce arabulucuya ba\u015fvurur; anla\u015fma sa\u011flanamazsa dava a\u00e7\u0131labilir.<\/li>\n<\/ul>\n<ol start=\"3\">\n<li>Tahliye Davas\u0131<\/li>\n<\/ol>\n<ul>\n<li>Ev sahibi, kirac\u0131 yeni kira bedelini \u00f6demezse <strong>tahliye davas\u0131<\/strong> a\u00e7abilir.<\/li>\n<li>Ancak bu dava, <strong>s\u00f6zle\u015fme s\u00fcresi<\/strong>, <strong>T\u00dcFE s\u0131n\u0131rlar\u0131<\/strong>, ve <strong>makul gerek\u00e7eler<\/strong> dikkate al\u0131narak de\u011ferlendirilir.<\/li>\n<\/ul>\n<p>Kirac\u0131n\u0131n Haklar\u0131<\/p>\n<ul>\n<li><strong>Yasal s\u0131n\u0131rlar\u0131 a\u015fan art\u0131\u015flara itiraz edebilir.<\/strong><\/li>\n<li><strong>S\u00f6zle\u015fme s\u00fcresi dolmadan tahliye edilmesi kolay de\u011fildir.<\/strong><\/li>\n<li><strong>Mahkemede savunma hakk\u0131 vard\u0131r.<\/strong><\/li>\n<\/ul>\n<p>Ev Sahibinin Haklar\u0131<\/p>\n<ul>\n<li><strong>T\u00dcFE oran\u0131na kadar art\u0131\u015f talep edebilir.<\/strong><\/li>\n<li><strong>S\u00f6zle\u015fme bitiminde yeni \u015fartlarla kira talep edebilir.<\/strong><\/li>\n<li><strong>Yasal prosed\u00fcrle tahliye talebinde bulunabilir.<\/strong><\/li>\n<\/ul>\n<p>Tavsiye<\/p>\n<ul>\n<li>Taraflar aras\u0131nda yaz\u0131l\u0131 ileti\u015fim kurmak ve <strong>T\u00dcFE oran\u0131na uygun tekliflerde bulunmak<\/strong> en sa\u011fl\u0131kl\u0131 yoldur.<\/li>\n<li>Anla\u015fmazl\u0131k durumunda <strong>arabuluculuk ba\u015fvurusu<\/strong> yap\u0131lmal\u0131; bu hem zaman hem maliyet a\u00e7\u0131s\u0131ndan daha avantajl\u0131d\u0131r.<\/li>\n<\/ul>\n<p>Kirac\u0131n\u0131n kira bedelini geciktirmesi veya hi\u00e7 \u00f6dememesi hem <strong>hukuki hem de s\u00f6zle\u015fme ba\u011flam\u0131nda sonu\u00e7lar<\/strong> do\u011furur. Bu durum, T\u00fcrk Bor\u00e7lar Kanunu\u2019nda a\u00e7\u0131k\u00e7a d\u00fczenlenmi\u015ftir ve ev sahibine \u00e7e\u015fitli haklar tan\u0131r.<\/p>\n<p>Hukuki S\u00fcre\u00e7ler ve Sonu\u00e7lar<\/p>\n<ol>\n<li>Yaz\u0131l\u0131 \u0130htar G\u00f6nderilmesi<\/li>\n<\/ol>\n<ul>\n<li>Ev sahibi, kirac\u0131ya <strong>yaz\u0131l\u0131 ihtar<\/strong> g\u00f6ndererek borcun belirli bir s\u00fcre i\u00e7inde \u00f6denmesini talep eder.<\/li>\n<li>Genellikle <strong>7 ila 15 g\u00fcn<\/strong> s\u00fcre tan\u0131n\u0131r.
