Bu durum, T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 308. maddesi ve ilgili i\u00e7tihatlarla netle\u015ftirilmi\u015ftir.<\/p>\n<p><em><u>Demirba\u015f Tamiratlar\u0131nda Sorumluluk Da\u011f\u0131l\u0131m\u0131<\/u><\/em><\/p>\n<p>Ev Sahibinin Sorumlulu\u011funda Olanlar<\/p>\n<ul>\n<li><strong>Kalorifer sistemi (petek, kombi)<\/strong><\/li>\n<li><strong>Su tesisat\u0131 (borular, musluklar)<\/strong><\/li>\n<li><strong>Elektrik tesisat\u0131<\/strong><\/li>\n<li><strong>\u00c7at\u0131, d\u0131\u015f cephe, izolasyon<\/strong><\/li>\n<li><strong>Bina ortak alanlar\u0131 (asans\u00f6r, mantolama vb.)<\/strong><\/li>\n<\/ul>\n<p>&#x27a1;&#xfe0f; Bu t\u00fcr ar\u0131zalar, kirac\u0131n\u0131n kullan\u0131m hatas\u0131ndan kaynaklanm\u0131yorsa <strong>ev sahibi taraf\u0131ndan giderilmelidir<\/strong>.<\/p>\n<p>Kirac\u0131n\u0131n Sorumlulu\u011funda Olanlar<\/p>\n<ul>\n<li><strong>K\u00fc\u00e7\u00fck bak\u0131m ve temizlik i\u015fleri<\/strong> (\u00f6rne\u011fin musluk contas\u0131n\u0131n de\u011fi\u015fimi)<\/li>\n<li><strong>Kendi kullan\u0131m\u0131ndan kaynaklanan hasarlar<\/strong><\/li>\n<li><strong>Kendi takt\u0131rd\u0131\u011f\u0131 cihazlar\u0131n tamirat\u0131<\/strong> (\u00f6rne\u011fin sonradan tak\u0131lan klima)<\/li>\n<\/ul>\n<p>Yasal Dayanak<\/p>\n<ul>\n<li><strong>TBKm.308:<\/strong><br \/>\nKiraya veren, kusuru olmad\u0131\u011f\u0131n\u0131 ispat edemedik\u00e7e, kiralanan\u0131n ay\u0131pl\u0131 olmas\u0131ndan do\u011fan zararlar\u0131 kar\u015f\u0131lamakla y\u00fck\u00fcml\u00fcd\u00fcr.<\/li>\n<li><strong>Yarg\u0131tay:<\/strong><br \/>\nDemirba\u015f niteli\u011findeki ar\u0131zalar\u0131n giderilmesi, kiraya verenin \u201ckullan\u0131ma uygun tutma\u201d borcu kapsam\u0131nda de\u011ferlendirilir.<\/li>\n<\/ul>\n<p>Tavsiye<\/p>\n<ul>\n<li>Kirac\u0131, ar\u0131zay\u0131 fark etti\u011finde <strong>yaz\u0131l\u0131 olarak ev sahibine bildirmeli<\/strong>.<\/li>\n<li>Ev sahibi tamirat\u0131 geciktirirse, kirac\u0131 <strong>tamir yapt\u0131r\u0131p bedeli kiradan d\u00fc\u015febilir<\/strong> (belgelendirme \u015fart\u0131yla).<\/li>\n<li>Kira s\u00f6zle\u015fmesinde demirba\u015f listesi yer almas\u0131, ileride \u00e7\u0131kabilecek uyu\u015fmazl\u0131klar\u0131 \u00f6nler.<\/li>\n<\/ul>\n<p><em><u>Kirac\u0131n\u0131n Yapaca\u011f\u0131 Tadilatlar Hakk\u0131nda<\/u><\/em><\/p>\n<p>Kirac\u0131n\u0131n evde yapaca\u011f\u0131 tadilatlar i\u00e7in genellikle <strong>ev sahibinden yaz\u0131l\u0131 izin almas\u0131 gerekir<\/strong>. Bu durum hem T\u00fcrk Bor\u00e7lar Kanunu hem de Yarg\u0131tay i\u00e7tihatlar\u0131yla netle\u015ftirilmi\u015ftir.<\/p>\n<p><em><u>Tadilat T\u00fcr\u00fcne G\u00f6re Sorumluluk<\/u><\/em><\/p>\n<ol>\n<li>K\u00fc\u00e7\u00fck De\u011fi\u015fiklikler<\/li>\n<\/ol>\n<ul>\n<li>Duvara tablo asmak, k\u00fc\u00e7\u00fck raflar yerle\u015ftirmek gibi <strong>yap\u0131sal olmayan<\/strong> de\u011fi\u015fiklikler.<\/li>\n<li>Genellikle ev sahibinin izni gerekmez, ancak <strong>bilgilendirme iyi niyet a\u00e7\u0131s\u0131ndan \u00f6nemlidir<\/strong>.<\/li>\n<\/ul>\n<ol start=\"2\">\n<li>B\u00fcy\u00fck Tadilatlar<\/li>\n<\/ol>\n<ul>\n<li>Duvar y\u0131kma, mutfak veya banyo yenileme, yeni oda a\u00e7ma gibi <strong>yap\u0131sal ve kal\u0131c\u0131 de\u011fi\u015fiklikler<\/strong>.<\/li>\n<li>Bu t\u00fcr i\u015flemler i\u00e7in <strong>ev sahibinin yaz\u0131l\u0131 izni zorunludur<\/strong>.<\/li>\n<li>\u0130zin al\u0131nmadan yap\u0131lan tadilatlar, <strong>m\u00fclkiyet hakk\u0131n\u0131n ihlali<\/strong> say\u0131labilir ve ev sahibi:<\/li>\n<li>Tazminat talep edebilir,<\/li>\n<li>S\u00f6zle\u015fmeyi feshedebilir.<\/li>\n<\/ul>\n<p>Yasal Dayanak ve Yarg\u0131tay G\u00f6r\u00fc\u015f\u00fc<\/p>\n<ul>\n<li>Yarg\u0131tay, kirac\u0131n\u0131n izinsiz yapt\u0131\u011f\u0131 b\u00fcy\u00fck tadilatlar\u0131 <strong>hukuka ayk\u0131r\u0131<\/strong> bulmakta ve ev sahibinin zararlar\u0131n\u0131 talep etme hakk\u0131n\u0131 tan\u0131maktad\u0131r.<\/li>\n<li>Kirac\u0131, ta\u015f\u0131nmazda kal\u0131c\u0131 de\u011fi\u015fiklik yapmadan \u00f6nce <strong>mutlaka ev sahibinin r\u0131zas\u0131n\u0131 almal\u0131d\u0131r<\/strong>.<\/li>\n<\/ul>\n<p>Tavsiye<\/p>\n<ul>\n<li>Tadilat plan\u0131 varsa, \u00f6nce ev sahibine <strong>yaz\u0131l\u0131 teklif sunulmal\u0131<\/strong>.<\/li>\n<li>Tadilat\u0131n kapsam\u0131, s\u00fcresi ve maliyeti net \u015fekilde belirtilmeli.<\/li>\n<li>M\u00fcmk\u00fcnse bu izin, <strong>kira s\u00f6zle\u015fmesine ek protokol<\/strong> olarak eklenmeli.<\/li>\n<\/ul>\n<p><em><u>Ortak Kullan\u0131m Alan\u0131 Giderlerinde Sorumluluk<\/u><\/em><\/p>\n<p>Ortak kullan\u0131m alanlar\u0131n\u0131n giderlerinden\u2014\u00f6rne\u011fin bina aidat\u0131, merdiven temizli\u011fi, asans\u00f6r bak\u0131m\u0131 gibi masraflardan\u2014<strong>\u00f6ncelikle kat malikleri (ev sahipleri)<\/strong> sorumludur. Ancak kirac\u0131lar da bu giderlere <strong>kira s\u00f6zle\u015fmesi kapsam\u0131nda<\/strong> dahil edilebilir.<\/p>\n<p>Yasal Dayanak: Kat M\u00fclkiyeti Kanunu (KMK) m.20\u2019ye g\u00f6re:<\/p>\n<ul>\n<li><strong>Kat malikleri<\/strong>, ortak alanlar\u0131n bak\u0131m, onar\u0131m, temizlik ve y\u00f6netim giderlerine <strong>arsa pay\u0131 oran\u0131nda<\/strong> kat\u0131lmakla y\u00fck\u00fcml\u00fcd\u00fcr.<\/li>\n<li>Aidat, kap\u0131c\u0131, bah\u00e7\u0131van, g\u00fcvenlik gibi giderler i\u00e7in toplanan avanslara da kat\u0131lmak zorundad\u0131rlar.<\/li>\n<li>Ortak alanlardan faydalanmasa bile bu giderlerden <strong>muaf olamazlar<\/strong>.<\/li>\n<\/ul>\n<p>Kirac\u0131n\u0131n Durumu<\/p>\n<ul>\n<li>Kirac\u0131, <strong>kira s\u00f6zle\u015fmesinde a\u00e7\u0131k\u00e7a belirtilmi\u015fse<\/strong>, aidat ve ortak giderleri \u00f6demekle y\u00fck\u00fcml\u00fc olabilir.<\/li>\n<li>Uygulamada genellikle:<\/li>\n<\/ul>\n<ul>\n<li><strong>Rutin giderler<\/strong> (temizlik, g\u00fcvenlik, asans\u00f6r bak\u0131m\u0131) \u2192 kirac\u0131ya yans\u0131t\u0131l\u0131r.<\/li>\n<li><strong>Demirba\u015f yenileme veya b\u00fcy\u00fck onar\u0131mlar<\/strong> \u2192 ev sahibinin sorumlulu\u011fundad\u0131r.<\/li>\n<\/ul>\n<p>Tavsiyeler<\/p>\n<ul>\n<li>Kira s\u00f6zle\u015fmesine <strong>\u201ckirac\u0131 aidat ve ortak giderleri \u00f6demeyi kabul eder\u201d<\/strong> gibi bir madde eklenmesi, ileride \u00e7\u0131kabilecek uyu\u015fmazl\u0131klar\u0131 \u00f6nler.<\/li>\n<li>Aidat\u0131n i\u00e7eri\u011fi (neye ne kadar \u00f6dendi\u011fi) <strong>y\u00f6netim plan\u0131 veya apartman karar defteri<\/strong> ile netle\u015ftirilmelidir.<\/li>\n<li>\u015eunu da unutmamak gerekir ki \u201ckirac\u0131n\u0131n \u00f6demedi\u011fi bina aidat\u0131ndan ev sahibi sorumlu olacakt\u0131r ancak ev sahibi sonradan \u00f6dedi\u011fi aidat i\u00e7in kirac\u0131ya r\u00fccu hakk\u0131n\u0131 sakl\u0131 tutar.\u201d<\/li>\n<\/ul>\n<p><em><u>Ev Sahibinin M\u00fclk\u00fc Olan Eve Girmesi Hakk\u0131nda<\/u><\/em><\/p>\n<p>Ev sahibi kirac\u0131n\u0131n izni olmadan eve giremez.
