Ev sahibine tazminat \u00f6demek zorunda kal\u0131r m\u0131?<\/p>\n<p>Kirac\u0131n\u0131n kira s\u00fcresi dolmadan evi erken bo\u015faltmas\u0131, T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 325. maddesi kapsam\u0131nda de\u011ferlendirilir. Bu durumda kirac\u0131, s\u00f6zle\u015fme s\u00fcresi sona erene kadar do\u011fabilecek zararlar\u0131 tazmin etmekle y\u00fck\u00fcml\u00fc olabilir. Ancak bu y\u00fck\u00fcml\u00fcl\u00fck, baz\u0131 ko\u015fullara ve istisnalara ba\u011fl\u0131d\u0131r.<\/p>\n<p>Yasal Dayanak: TBK m.325<\/p>\n<p><strong><em>Kirac\u0131 Erken Tahliye Ederse Ne Olur?<\/em><\/strong><\/p>\n<ol>\n<li>Kiraya Veren Zarar G\u00f6r\u00fcrse\n<ul>\n<li>Kiralanan yer bo\u015f kal\u0131r ve yeni kirac\u0131 bulunamazsa, eski kirac\u0131:<\/li>\n<li>Kalan kira bedellerinden,<\/li>\n<li>Bo\u015fta kalan s\u00fcredeki zarar ve masraflardan,<\/li>\n<li>Gerekirse tazminat \u00f6demekten sorumlu tutulabilir.<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<ol start=\"2\">\n<li>Yeni Kirac\u0131 Bulunursa<\/li>\n<\/ol>\n<ul>\n<li>Kiraya veren, makul s\u00fcrede yeni kirac\u0131 bulursa:<\/li>\n<li>Eski kirac\u0131n\u0131n sorumlulu\u011fu sona erer.<\/li>\n<li>Tazminat talep edilemez.<\/li>\n<\/ul>\n<ol start=\"3\">\n<li>S\u00f6zle\u015fmede Cezai \u015eart Varsa<\/li>\n<\/ol>\n<ul>\n<li>E\u011fer s\u00f6zle\u015fmede \u201cerken \u00e7\u0131karsa kalan aylar\u0131n kiras\u0131n\u0131 \u00f6der\u201d gibi bir madde varsa:<\/li>\n<li>Kirac\u0131, evi kiraya verseler bile s\u00f6zle\u015fme s\u00fcresi sonuna kadar kira \u00f6demekle y\u00fck\u00fcml\u00fc olabilir.<\/li>\n<li>Yarg\u0131tay, bu t\u00fcr cezai \u015fartlar\u0131 \u201cahde vefa\u201d ilkesi gere\u011fi ge\u00e7erli saymaktad\u0131r.<\/li>\n<\/ul>\n<p><em><u>Makul S\u00fcre ve Tazminat\u0131n S\u0131n\u0131r\u0131<\/u><\/em><\/p>\n<ul>\n<li>Yarg\u0131tay uygulamas\u0131na g\u00f6re, kiraya verenin zarar\u0131n\u0131n tazmini \u201cmakul s\u00fcre\u201d ile s\u0131n\u0131rl\u0131d\u0131r.<\/li>\n<\/ul>\n<p>\u00d6rne\u011fin: Bilirki\u015fi, ta\u015f\u0131nmaz\u0131n 3 ayda kiraya verilebilece\u011fini belirlerse, kirac\u0131 en fazla 3 ayl\u0131k kira bedelinden sorumlu olur.<\/p>\n<p>Tavsiye<\/p>\n<ul>\n<li>Kirac\u0131 erken \u00e7\u0131kacaksa, <strong>en az 2 ay \u00f6nceden yaz\u0131l\u0131 bildirim<\/strong> yapmal\u0131.<\/li>\n<li>Kiraya veren, yeni kirac\u0131 bulmak i\u00e7in <strong>makul \u00e7aba g\u00f6stermelidir<\/strong>.<\/li>\n<li>S\u00f6zle\u015fmede cezai \u015fart varsa, <strong>a\u00e7\u0131k ve net \u015fekilde d\u00fczenlenmi\u015f olmal\u0131d\u0131r<\/strong>.<\/li>\n<\/ul>\n<p><strong><em>Malikin Kirac\u0131y\u0131 Tahliye Edebilme Durumlar\u0131<\/em><\/strong><\/p>\n<p>Ev sahibi, kirac\u0131y\u0131 keyfi olarak tahliye edemez; tahliye ancak <strong>T\u00fcrk Bor\u00e7lar Kanunu<\/strong>\u2019nda belirtilen yasal gerek\u00e7elere dayanarak m\u00fcmk\u00fcnd\u00fcr. \u0130\u015fte hem konut hem de ticari kiralamalarda ge\u00e7erli olan ba\u015fl\u0131ca tahliye sebepleri:<\/p>\n<p><u>Yasal Tahliye Sebepleri<\/u><\/p>\n<ol>\n<li>Kira Borcunun \u00d6denmemesi<\/li>\n<\/ol>\n<ul>\n<li>Kirac\u0131 kira bedelini \u00f6demezse, ev sahibi <strong>noter arac\u0131l\u0131\u011f\u0131yla ihtar<\/strong> g\u00f6nderir.<\/li>\n<li><strong>30 g\u00fcn i\u00e7inde \u00f6deme yap\u0131lmazsa<\/strong>, TBK m.315 uyar\u0131nca <strong>tahliye davas\u0131<\/strong> a\u00e7\u0131labilir.<\/li>\n<\/ul>\n<ol start=\"2\">\n<li>\u0130ki Hakl\u0131 \u0130htar<\/li>\n<\/ol>\n<ul>\n<li>Bir kira y\u0131l\u0131 i\u00e7inde <strong>iki kez hakl\u0131 ihtar<\/strong> g\u00f6nderilmi\u015fse, ev sahibi TBK m.352\/2\u2019ye g\u00f6re tahliye talep edebilir.<\/li>\n<\/ul>\n<ol start=\"3\">\n<li>Tahliye Taahh\u00fctnamesi<\/li>\n<\/ol>\n<ul>\n<li>Kirac\u0131, belirli bir tarihte evi bo\u015faltaca\u011f\u0131na dair <strong>yaz\u0131l\u0131 taahh\u00fct<\/strong> vermi\u015fse, bu belgeye dayanarak tahliye istenebilir.<\/li>\n<li>Ancak taahh\u00fct, kira s\u00f6zle\u015fmesinden <strong>ayr\u0131 bir tarihte<\/strong> ve <strong>\u00f6zg\u00fcr iradeyle<\/strong> verilmi\u015f olmal\u0131d\u0131r.<\/li>\n<\/ul>\n<ol start=\"4\">\n<li>Konut veya \u0130\u015f Yeri \u0130htiyac\u0131<\/li>\n<\/ol>\n<ul>\n<li>Ev sahibi, kendisi, e\u015fi, \u00e7ocuklar\u0131 veya bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu ki\u015filer i\u00e7in <strong>ger\u00e7ek ve samimi bir ihtiya\u00e7<\/strong> nedeniyle tahliye talep edebilir.<\/li>\n<li>Mahkemeler bu ihtiyac\u0131 detayl\u0131 \u015fekilde inceler.<\/li>\n<\/ul>\n<ol start=\"5\">\n<li>Yeniden \u0130n\u015fa veya Tadilat<\/li>\n<\/ol>\n<ul>\n<li>Kiralanan yerin <strong>yeniden in\u015fas\u0131 veya kapsaml\u0131 tadilat\u0131<\/strong> gerekiyorsa ve bu s\u00fcre\u00e7te kirac\u0131n\u0131n kalmas\u0131 m\u00fcmk\u00fcn de\u011filse, tahliye talep edilebilir.<\/li>\n<\/ul>\n<ol start=\"6\">\n<li>10 Y\u0131ll\u0131k Uzama S\u00fcresi<\/li>\n<\/ol>\n<ul>\n<li>Belirli s\u00fcreli s\u00f6zle\u015fmelerde, <strong>10 y\u0131l dolduktan sonra<\/strong>, ev sahibi her yeni kira y\u0131l\u0131nda <strong>3 ay \u00f6nceden bildirimle<\/strong> tahliye talep edebilir.<\/li>\n<\/ul>\n<ol start=\"7\">\n<li>S\u00f6zle\u015fmeye Ayk\u0131r\u0131 Kullan\u0131m<\/li>\n<\/ol>\n<ul>\n<li>Kirac\u0131, evi s\u00f6zle\u015fmede belirtilen amac\u0131n d\u0131\u015f\u0131nda kullan\u0131yorsa (\u00f6rne\u011fin konutu i\u015fyeri yapmak), tahliye gerek\u00e7esi do\u011far.<\/li>\n<\/ul>\n<ol start=\"8\">\n<li>Kirac\u0131n\u0131n Ba\u015fka Evi Olmas\u0131<\/li>\n<\/ol>\n<ul>\n<li>Kirac\u0131n\u0131n veya e\u015finin ayn\u0131 b\u00f6lgede <strong>kendi m\u00fclk\u00fc varsa<\/strong> ve bu durum sonradan \u00f6\u011frenilmi\u015fse, ev sahibi tahliye talep edebilir.<\/li>\n<\/ul>\n<p>Yarg\u0131tay G\u00f6r\u00fc\u015f\u00fc<\/p>\n<ul>\n<li><strong>Yarg\u0131tay<\/strong>, tahliye taahh\u00fctnamesinin ge\u00e7erlili\u011fi i\u00e7in belgenin kira s\u00f6zle\u015fmesinden ayr\u0131 ve \u00f6zg\u00fcr iradeyle verilmi\u015f olmas\u0131n\u0131 \u015fart ko\u015far.<\/li>\n<li><strong>\u0130htiya\u00e7 nedeniyle tahliye<\/strong> davalar\u0131nda, ev sahibinin ger\u00e7ekten ta\u015f\u0131nmazda oturup oturmayaca\u011f\u0131 detayl\u0131 \u015fekilde incelenir.<\/li>\n<\/ul>\n<p><strong><em>Peki Nedir Bu Tahliye Taahh\u00fctnamesi?<\/em><\/strong><\/p>\n<p><strong>Tahliye taahh\u00fctnamesi<\/strong>, kirac\u0131n\u0131n belirli bir tarihte kiralanan ta\u015f\u0131nmaz\u0131 bo\u015faltaca\u011f\u0131n\u0131 yaz\u0131l\u0131 olarak taahh\u00fct etti\u011fi bir belgedir. Bu belge, <strong>T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 352. maddesi<\/strong> uyar\u0131nca d\u00fczenlenir ve ev sahibine, belirtilen tarihten itibaren kirac\u0131n\u0131n tahliyesini talep etme hakk\u0131 tan\u0131r.<\/p>\n<p><u>Hukuki Ge\u00e7erlilik \u015eartlar\u0131<\/u><\/p>\n<p>Ge\u00e7erli say\u0131labilmesi i\u00e7in \u015fu kriterlerin sa\u011flanmas\u0131 gerekir:<\/p>\n<ul>\n<li><strong>Yaz\u0131l\u0131 olmal\u0131<\/strong>: Basit yaz\u0131l\u0131 \u015fekil yeterlidir; noter \u015fart\u0131 yoktur ama noter onay\u0131 ispat a\u00e7\u0131s\u0131ndan faydal\u0131d\u0131r.<\/li>\n<li><strong>Kira s\u00f6zle\u015fmesinden ve ta\u015f\u0131nmaz\u0131n tesliminden sonra imzalanmal\u0131<\/strong>: Ayn\u0131 g\u00fcn veya \u00f6ncesinde imzalanan belgeler, bask\u0131 alt\u0131nda verilmi\u015f say\u0131labilir ve Yarg\u0131tay i\u00e7tihatlar\u0131yla ge\u00e7ersiz say\u0131labilir.<\/li>\n<li><strong>Tahliye tarihi a\u00e7\u0131k ve belirli olmal\u0131<\/strong>: \u201c01.12.2025\u201d gibi net bir tarih belirtilmelidir.
